Key Points
103rd Constitutional Amendment in 2019, Article 15(6) and 16(6) of the Indian Constitution -
- On January 9th 2019, the Parliament of India enacted the Constitution (One Hundred and Third Amendment) Act, 2019 which enabled the State to make reservations in higher education and matters of public employment on the basis of economic criteria alone.
- The Act amended Articles 15 and 16 of the Constitution by inserting 15(6) and 16(6).
- The Amendment under Article 15(6) enables the State to make special provisions for the advancement of any economically weaker section of citizens, including reservations in educational institutions.
- The amendment was made to provide for 10% reservation to the citizens, belonging to the Economic Weaker Section (EWS) category in the jobs and educational institutions to the economically backward section in the general category. Hence statement b is not correct and statements c and d are correct.
- It was enacted to promote the welfare of the poor not covered by the 50% reservation policy for SCs, STs and Socially and Educationally Backward Classes (SEBC). Hence statement a is not correct.
- The reservation to the EWS category was provided without touching upon the existing scheme of reservation for the backward classes which include Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs).
