Which of the following condition is true, when Parliament can make laws regarding state list? (i) During National Emergency (ii) When two or more states request parliament to make law. (iii) Law made by parliament on request is binding to all the states of India. Correct Answer Statement (i) and (ii)
The correct answer is Statement (i) and (ii).
- Parliament can legislate on subjects of State List under three conditions:
- In the case of the national emergency (Article 250).
- When Rajya Sabha passes the resolution.
- When two or more states pass a resolution requesting Parliament to make law on particular subjects under State List
- But other states are not binding for that law, the law made is only applicable to such states that passed a resolution.
