Powers of the President of India:
- Appointment of Prime Minister:
- Article 75 says only that the Prime Minister shall be appointed by the president.
- Article 72 of the Constitution.
- The President shall have the power to grant pardons, reprieves, respites, or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence where the sentence is a sentence of death.
- But he/she cannot exercise his/her power of pardon independent of the government.
- The President of India holds the power to remove a Judge of the High Court, from his office when each house of the parliament passes a resolution by a two third majority of its members present and voting in each house requesting the president to remove the judge.

If any question arises as to whether a member of either House of Parliament has become subject to any of the disqualifications mentioned in clause ( 1 ) of Article 102, the question shall be referred for the decision of the President and his decision shall be final

Before giving any decision on any such question, the President shall obtain the opinion of the Election Commission and shall act according to such opinion.
