Article 15 provides the prohibition of discrimination on grounds only of religion, race, caste, sex or place of birth.

  • The word ‘only’ means that discrimination from other grounds is not prohibited.
  • Article 15 says no citizen shall be subjected to any disability, liability or restrictions on the grounds mentioned above with regard to:
    • Accessing the shop, hotels, public restaurant, entertainment places etc.
    • Usage of well, tanks, public baths and resorts which are wholly or partly maintained by the State or dedicated to the public.
  • There are some exceptions with regard to non-discrimination:
    • The state is permitted to make any special provision for women and children.
    • The state is permitted to make any special provision for socially and educationally backward classes of the citizen or scheduled caste or scheduled tribes.
    • One more provision was added by 93rd Amendment Act of 2005 says that the state is empowered to make any special provision for socially and educationally backward classes of the citizen or scheduled caste or scheduled tribes regarding their admission in educational institutions.
      • In order to give effect to this provision centre enacted the Central Educational Institutions (Reservation in Admission) Act 2006.
