জাতীয় সংসদে পঞ্চম সংশোধনী আনা হয় 6 এপ্রিল 1979 সালে। এ সংশোধনী 1975 এর 15 ই আগস্ট সামরিক শাসন জারির পর থেকে 6 এপ্রিল 1979 পর্যন্ত সামরিক শাসন আমলের সব আদেশ ঘোষণা ও দণ্ডাদেশ বৈধতা পাই। একে বলা হয় Indemnity অধ্যাদেশ। এতে রাষ্ট্র পরিচালনার মূল অর্থনীতিতেও কিছু পরিবর্তন আনা হয়। তাই এই সংশোধনীকে first distortion of constitution বলে আখ্যায়িত করা হয়।
